The Corporate Manslaughter Act

 

 

The Corporate Manslaughter Act came into force on 6 April 2008. This legislation, allowed corporate bodies and individuals to be prosecuted for any separate health and safety offences.

Health and Safety law places an obligation for employers to establish safe systems of work through undertaking risk assessments. The HSE Guide, "Driving at Work" (INDG382) makes it clear that "health and safety law applies to on-the-road work activities". Therefore, as the activity of operating and driving a minibus falls within the remit of an on-the-road work activity, a Minibus Operations and Road Safety policy should be part of your safe system of work.

The success of a Minibus Operations and Road Safety Policy is a shared responsibility between your organisation and drivers. However, you may find minibus laws and regulations still confusing, despite taking on the responsibilities of a minibus.

Therefore the benefits of having a minibus operator heath check will ensure that your organisation and drivers can implement and follow a policy of safe procedures which complies with Health & Safety and Road Traffic law, thus greatly reducing any risk of being prosecuted.
